CODE ON SOCIAL SECURITY, 2020 ( Act No. 36 of 2020)

This Act was enacted by Parliament in 2020 to consolidate and amend the laws relating to social security, with the objective of extending social security benefits to all employees and workers in the organised, unorganised, and other sectors, and for matters connected therewith or incidental thereto. Following provisions the Act came into force with effect from 21st November 2025, vide S.O. No. 5319 (E) dated 21-11-2025, published in the Gazette of India (Extraordinary), Part II, Section 3, Sub-section (ii). Section 1 to 14,sub-section (1) and (2) of section 15, clause (c) of sub-section(1) of section 16, section 17 to 141, section 143 , except the provision of the Code specified at serial No.(v) of S.O. 2060 (E) dated 3rd May 2023, section 144 to 163, Item 1 and 2 and item 4 to 9 of sub-section (1) of section 164 and clause (a) and clause (c) of sub-section (2) and sub-section (3) of section 164. Following provisions were came into force vide S.O. No. 2060 (E) dated 3rd May,2023 : (i) sub-section (3) of section 15, in so far as it relates to the Employees’ Pension Scheme, 1995; (ii) clause (a) of sub-section (1) of section 16, in so far as it relates to the Employees’ Pension Scheme, 1995; (iii) clause (b) of sub-section (1) of section 16; (iv) sub-section (2) of section 16, in so far as it relates to the Employees’ Pension Scheme, 1995; (v) section 143, in so far as it applies in giving effect to the provisions of sub-clause (ii) of clause (b) of sub-section (1) of section 16 in relation to the Employees’ Pension Scheme, 1995; (vi) sub-section (1) of section 164 to repeal the corresponding provisions of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952) specified in item 3 thereof; and (vii) clause (b) of sub-section (2) of section 164 in so far as it relates to the Employees’ Pension Scheme, 1995.
